Note: To reduce the amount of spam and account abuse the following rules are in effect: 1. To activate your first account a $1 fee has to be paid through paypal (with a note mentioning the EXACT username registered) in order for the account to be activated. 2. Additional accounts are $5 (also payable through paypal). 3. Accounts opened by users that have been banned require a $10 fee (also payable through paypal). 4. THE FIRST TWO (2) POSTS made by any user will go to a "moderation queue" where they will be reviewed BEFORE they appear in the forums. This may take some time (depending on moderator availability). 5. People with fewer than 2 posts (aka "New Users") CANNOT start a new thread. 6. "New Users" CANNOT change their registration profile. 7. (the makers of the forums software), and their agents with respect to any claim arising from your use of this message broad. Copyright ED MATERIALS RULES You agree, not to post any copyrighted material on the forums unless: 1. You are the copyright holder. If so, it is suggested that you include details as to what uses are permitted for the picture, for example: use restricted to the forums post, limited use on NESurf.com (for example, in the “Photos” section). [b]Absent any such information NESurf.com will assume it has free use of the image.[/b] 2. You have the expressed permission from the copyright holder. 3. If NESurf.com is the sole copyright holder of the material. Copyrighted material posted in the forums will be assumed by th owner to have all the necessary permissions. Should this not be the case a complaint can be lodged by sending an email to copyrights@nesurf.com. Any account that receives a copyright complaint will be banned immediately (and the copyrighted material will be removed). IDENTITY/SCREENNAME RULES You agree not to impersonate any person or entity, including but not limited to, other users, the owner, an NESurf.com official, or host or falsely state or otherwise misrepresent your affiliation with a person or entity. IDs created for the purpose of creating confusion and misrepresentation will be banned immediately. [b]GENERAL POSTING RULES[/b] By using the forums you agree to abide by the following rules (Note: all rules apply to regular posting as well Reputation Comments, but not to emails, Private Messages): 1. [b]No put-downs, name-calling or insults[/b] aimed at local surf figures or users of the forums. Exceptions are generally made for humor. Only the Webmaster can be referred to as a Kook. Workaround: if you disagree with/are offended by a post attack the words posted not the person writing. 2. No racial slurs. Workaround: you're not funny, you're not welcome here. 3. No homophobic slurs. Workaround: leave. 4. No “Argumentum Ad Hominem” fallacies. Don’t know what it means? Look it up. Here’s a handy link: http://www.nizkor.org/features/fallacies/ad-hominem.html . Workaround: use logic, not personal attacks. 5. No “date requested” posts (including requests for pictures, personal information etc.). There are plenty dating websites, NESurf.com is not one of them. Workaround: go elsewhere. 6. No posting of pornographic pictures or "deceptively labeled" links to pornographic sites. Workaround: if you really want to make a point with a pornographic picture, post a clearly marked url link (thus protecting those that may be accessing from work). 7. Advertisements, chain letters, pyramid schemes, and solicitations are inappropriate on these forums (exception: the Buy, Sell, Trade forum). Workaround: if you're a spammer, burn in hell, if you're looking to sell surf equipment use the Buy, Sell, Trade forum. 8. Statements that may be construed by a reasonable person as threats are not permitted. Workaround: don’t do it, the last thing the internet or these forums need is yet another "internet tough guy" hiding behind an anonymous screen name. 9. Abuse of the INFRACTION SYSTEM is not permitted. Workaround: don’t do it, just follow the instructions below. INFRACTION SYSTEM Violations GENERAL POSTING RULES are enforced by the moderators and trustees (moderators) of the forums through the infraction system. 1. a. Infractions for posts: Moderators of the forums give an "infraction" or a "warning" to another user for any violation of the rules in a post. This is done by clicking on the infraction button (the red and yellow cards under the username) for the post where the infraction occurred, selecting the infraction type and, if desired, the warning option (this will result in no "infraction point" being assessed against the user). Further rules and details for the use of the infraction system are shown once the infraction button is clicked. Read them with care and follow them strictly. 1. b. Infractions for Reputation Comments and Personal Profiles: Any user of the forums issue a complaint or a "warning" to another user for any violation of the rules in a Reputation Comment and/or Personal Profile. This is done by clicking on the "Report Post" link for any post from the user and cutting and pasting the Reputation Comment that triggered the complaint or include details as to why an infraction should be given. Moderator discretion applies as to whether and infraction will be issued. 2. Most infractions result in getting 1 "infraction point", but sometimes Moderators may chose to ban a user immediately and permanently (for the most egregious offenses as well as spam). 6. Spambots get an immediate and permanent ban (infraction points are NOT reversed over time). 7. If you receive and infraction you get a chance to present your side of the story here: http://www.nesurf.com/forums/forumdisplay.php?f=28 . Find the thread relative to your infraction and post a reply explaining yourself. After 2 infraction points you loose your personal messaging (PM) rights, as well as are subject to restrictions on your account (aka “PM Infarcted” and “PM Banned”) and after 3 infraction points you are suspended for 2 weeks pending an "official review" (aka “Infarcted” and “User Suspended by Infractions”). If the infractions are found to be legit by NESurf.com moderators the ban can become either permanent (resulting in the account, and possibly IP addresses related to the account being permanently banned)or left to expire as the infraction points expire, usually a month (resulting in reinstatement of the account). NESURF.COM’S RIGHTS OVER POSTS Although NESurf.com does not and cannot review all the messages posted and is not responsible for the content of any of these messages, however, it reserves the right to delete (in its entirety or in part), move to another forum, or otherwise edit any message posted on any of the forums for any or no reason whatsoever. NESURF.COM’S RIGHTS OVER USER ACCOUNTS NESurf.com reserves the right to suspend, close, change, or delete any account that violates the rules contained in this agreement and/or for any or no reason whatsoever. PRIVACY RIGHTS NESurf.com reserves the right to reveal the user’s identity (and/or whatever information known about the user’s identity) in the event of: 1. ANY complaint by another user, moderator or administrator, 2. Legal action against the user, and/or 3. Any violation of this agreement or other forum policies (whether the user has been notified of such violations or not). 4. To expose users that utilize multiple accounts to disrupt or undermine "civil" exchanges in the forums. RULES SUBJECT TO CONSTANT CHANGE These policies are subject to change without notice.
